Welcome to BikeLens. These Terms of Service ("Terms") govern your access to and use of the BikeLens website at bikelens.app and the services offered through it (together, the "Service"), operated by BikeLens ("BikeLens", "we", "us", or "our"). By using the Service, you agree to these Terms and to our Privacy Policy.
Agreement to terms
By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Eligibility & accounts
- You must be at least 16 years old to use the Service.
- You are responsible for the accuracy of the information you provide and for all activity that occurs under your account.
- You are responsible for keeping access to your account secure. Notify us promptly at bikelensapp@gmail.com if you suspect unauthorised use.
The Service
BikeLens provides tools to compare bicycle geometry, save comparisons, and generate fit and size guidance from measurements you enter. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use. We may add, change, or remove features at any time.
Acceptable use
You agree not to:
- Scrape, harvest, crawl, or bulk-extract data from the Service, or use it to build a competing product or dataset.
- Copy, resell, sublicense, or commercially exploit the Service or its content without our written permission.
- Reverse engineer, decompile, or attempt to extract source code, except where such restriction is prohibited by law.
- Interfere with, disrupt, overload, or attempt to gain unauthorised access to the Service or its infrastructure.
- Use the Service to violate any law or infringe anyone's rights, or upload malicious code.
We may suspend or terminate access for conduct that breaches this section.
Subscriptions & billing
- The Service offers a free tier and a paid "Pro" subscription. Paid features are identified in the app.
- Payments are processed by Stripe. By subscribing, you authorise us (via Stripe) to charge your payment method the applicable fees, including recurring fees.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. We will charge the payment method on file for each renewal.
- We may change subscription prices; we will give reasonable advance notice, and changes apply from your next billing period.
- You are responsible for any taxes that apply to your purchase.
Cancellation & refunds
- You can cancel your subscription at any time through your account (via the Stripe billing portal). Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
- Except where required by law, fees already paid are non-refundable, and we do not provide refunds or credits for partial periods.
- EU/UK consumers. Where you have a statutory right to cancel a purchase within 14 days, that right still applies. By starting to use a paid digital feature immediately, you acknowledge that you may lose that cancellation right once the service has been fully performed.
Your content & data
You retain ownership of the data you provide - such as your measurements, saved bikes, and comparisons. You grant us a limited licence to host, store, and process that data solely to operate and improve the Service, as described in our Privacy Policy. You are responsible for ensuring you have the right to provide any data you submit.
Intellectual property
The Service, including its software, design, text, and compiled geometry database, is owned by BikeLens or its licensors and is protected by intellectual property laws. Bike names, brands, and trademarks belong to their respective owners and are used for identification only. Except for the licence to use the Service granted above, no rights are transferred to you.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Specifically:
- Not fitting or medical advice. Geometry comparisons, fit windows, and size recommendations are estimates for general guidance only. They are not a substitute for a professional bike fit or medical advice. Always confirm sizing with the manufacturer or a qualified fitter, and ride within your ability.
- Data accuracy. Geometry and specification data is compiled from third-party sources and may be incomplete, out of date, or contain errors. We do not warrant its accuracy and you should verify anything you rely on with the manufacturer.
- AI summaries. AI-generated comparison summaries are produced automatically and may be inaccurate or incomplete. They are not professional advice and should not be your sole basis for a purchase.
You use the Service, and make any purchasing decisions, at your own risk.
Limitation of liability
To the maximum extent permitted by law, BikeLens and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, or for fraud.
Indemnification
You agree to indemnify and hold harmless BikeLens and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your breach of these Terms, to the extent permitted by law.
Dispute resolution & arbitration
Please read this section carefully - it affects your legal rights.
This section applies to the fullest extent permitted by applicable law. It may not apply to you if you are a consumer in a jurisdiction (such as the UK or EU) where pre-dispute arbitration agreements against consumers are not enforceable; in that case, the "Governing law" section below applies to your disputes instead.
Binding arbitration
You and BikeLens agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration, rather than in court, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will take place in [US City, State], or be conducted remotely, and judgment on the award may be entered in any court with jurisdiction.
Class-action waiver
You and BikeLens agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
Exceptions (carve-outs)
Notwithstanding the above, either party may:
- bring an individual claim in small-claims court if it qualifies; and
- seek injunctive or equitable relief in court to protect its intellectual property or confidential information.
Your right to opt out
You can opt out of this arbitration agreement and class-action waiver by emailing bikelensapp@gmail.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
Governing law
These Terms are governed by the laws of [Governing State / Country], without regard to its conflict-of-laws rules. Where a dispute is not subject to arbitration (including where you are a consumer with mandatory local protections), it will be resolved by the competent courts of your place of residence or of [Governing State / Country], as required by applicable law. Nothing in these Terms removes mandatory consumer-protection rights available to you in your country of residence.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution - will survive.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
